Da, exact, Codul Muncii prevede la art. 264 \u0219i art. 265 faptele care constituie infrac\u021biuni potrivit legisla\u021biei muncii, c\u00e2t \u0219i sanc\u021biunile aplicabile \u00een cazul s\u0103v\u00e2r\u0219irii acestora de c\u0103tre angajatori.<\/p>\n<p>Faptele prev\u0103zute de\u00a0Codul Muncii pentru care intervine r\u0103spunderea penal\u0103 se completeaz\u0103 \u00eens\u0103 cu \u00a0celelalte infrac\u021biuni\u00a0 prev\u0103zute \u00een Codul Penal, ce pot fi s\u0103v\u00e2r\u0219ite de persoane care intr\u0103 sub inciden\u021ba unor raporturi de munca. (ex.: infrac\u021biuni de serviciu sau \u00een leg\u0103tur\u0103 cu serviciul).<\/p>\n<p><strong>Haide\u021bi s\u0103 vedem care sunt de fapt acele fapte care \u00een percep\u021bia Codului Muncii reprezint\u0103 infrac\u021biuni. <\/strong><\/p>\n<ol>\n<li><strong><em>Codul Muncii, art. 264 alin. 1<\/em><\/strong><strong> \u2013 stabilirea, \u00een mod repetat, pentru salaria\u021bii \u00eencadra\u021bi \u00een baza contractului individual de munc\u0103 a unor salarii sub nivelul salariului minim brut pe \u021bar\u0103 garantat \u00een plat\u0103, prev\u0103zut de lege.<\/strong><\/li>\n<\/ol>\n<p>\u00cen acest sens, s\u0103var\u0219irea infrac\u021biunii presupune existen\u021ba unor raporturi de munc\u0103 \u00eentre angajator \u0219i salaria\u021bi, \u00een baza unor contracte individuale de munc\u0103.<\/p>\n<p>Pentru a se putea re\u021bine \u00eens\u0103\u00a0 \u00een sarcina angajatorului s\u0103v\u00e2r\u0219irea acestei infrac\u021biuni, conduita infrac\u021bional\u0103 a acestuia trebuie s\u0103 se manifeste prin\u00a0 stabilirea, \u00een mod repetat, a unor salarii sub nivelul salariului minim brut pe \u021bar\u0103 garantat \u00een plat\u0103, prevazut de lege. A\u0219adar, de caracterul repetitiv al ac\u021biunilor angajatorului, depinde \u00eens\u0103\u0219i existen\u021ba infrac\u021biunii<\/p>\n<p><strong>Sanc\u021biunea prevazut\u0103 de legiuitor \u00een cazul s\u0103v\u00e2r\u0219irii acestei infrac\u021biuni este \u00eenchisoarea de la 6 luni la un an sau amend\u0103 penal\u0103<\/strong>.<\/p>\n<ol start=\"2\">\n<li><strong><em>Codul Muncii, art. 264 alin. 2<\/em><\/strong> <strong>\u2013 refuzul nejustificat al unei persoane de a prezenta organelor competente documentele legale, \u00een scopul \u00eempiedic\u0103rii verific\u0103rilor privitoare la aplicarea reglement\u0103rilor generale \u015fi speciale \u00een domeniul rela\u0163iilor de munc\u0103, securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103, \u00een termen de cel mult 15 zile de la primirea celei de-a doua solicit\u0103ri.<\/strong><\/li>\n<\/ol>\n<p>\u00cen aceast\u0103 situa\u021bie, inspectorii de munc\u0103 au dreptul s\u0103 sesizeze organele de urm\u0103rire penal\u0103 cu privire la refuzul nejustificat al angajatorului de a prezenta documentele necesare \u00een scopul efectu\u0103rii de verific\u0103ri.<\/p>\n<p>Ca \u0219i \u00een cazul prev\u0103zut de art. 264 alin. 1 Codul Muncii,<strong> sanc\u021biunea prevazut\u0103 de legiuitor \u00een cazul s\u0103v\u00e2r\u0219irii acestei infrac\u021biuni este \u00eenchisoarea de la 6 luni la un an sau amenda penal\u0103.<\/strong><\/p>\n<ol start=\"3\">\n<li><strong><em>Codul Muncii, art. 264 alin. 3 <\/em><\/strong><strong>\u2013<\/strong> <strong>\u00eempiedicarea sub orice form\u0103 a organelor competente de a intra, \u00een condi\u0163iile prev\u0103zute de lege, \u00een sedii, incinte, spa\u0163ii, terenuri sau mijloace de transport pe care angajatorul le folose\u015fte \u00een realizarea activit\u0103\u0163ii lui profesionale, pentru a efectua verific\u0103ri <\/strong><strong>privitoare la aplicarea reglement\u0103rilor generale \u015fi speciale \u00een domeniul rela\u0163iilor de munc\u0103, securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103.<\/strong><\/li>\n<\/ol>\n<p>\u00cen baza art 19, lit. a) din Legea nr. 108\/1999 pentru \u00eenfiin\u021barea \u0219i organizarea Inspec\u021biei Muncii, inspectorii de munc\u0103 trebuie s\u0103 aib\u0103 acces liber, permanent \u0219i f\u0103r\u0103 \u00een\u0219tiin\u021bare prealabil\u0103, \u00een sediul oric\u0103rui angajator, precum \u0219i \u00een orice alt loc de munc\u0103 organizat de angajator.<\/p>\n<p>A\u0219adar, accesul inspectorilor de munc\u0103 trebuie permis atat la sediul social al persoanei juridice, c\u00e2t \u0219i \u00een oricare dintre spa\u021biile \u00een care aceasta \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea, iar <strong>interzicerea accesului organelor competente, \u00een scopul efectu\u0103rii de verific\u0103ri, \u00een sedii, incinte, spa\u0163ii, terenuri sau mijloace de transport utilizate de angajator pentru desf\u0103\u0219urarea de activit\u0103\u021bi lucrative, constituie infrac\u021biune \u0219i este sanc\u021bionat\u0103 cu \u00eenchisoarea de la 6 luni la un an sau amend\u0103 penal\u0103.<\/strong><\/p>\n<ol start=\"4\">\n<li><strong><em>Codul Muncii, art. 265 alin. 1<\/em><\/strong> <strong>\u2013 \u00eencadrarea \u00een munc\u0103 a unui minor cu nerespectarea condi\u0163iilor legale de v\u00e2rst\u0103 sau folosirea acestuia pentru prestarea unor activit\u0103\u0163i cu \u00eenc\u0103lcarea prevederilor legale referitoare la regimul de munc\u0103 al minorilor.<\/strong><\/li>\n<\/ol>\n<p>La \u00eencheierea unui contract de munc\u0103 cu un minor angajatorul va trebui sa tin\u0103 seama de dispozi\u021biile art. 13 din Codul Muncii, care prev\u0103d faptul c\u0103 persoana fizic\u0103 dob\u00e2nde\u015fte capacitate de munc\u0103 la \u00eemplinirea v\u00e2rstei de 16 ani, iar \u00eencheierea unui contract de munc\u0103 cu un minor care a \u00eemplinit v\u00e2rsta de 15 ani, se poate realiza doar cu acordul p\u0103rin\u0163ilor sau al reprezentan\u0163ilor legali \u0219i numai pentru activit\u0103\u0163i potrivite cu dezvoltarea fizic\u0103, aptitudinile \u015fi cuno\u015ftin\u0163ele sale, f\u0103r\u0103 a-i fi periclitat\u0103 s\u0103n\u0103tatea, dezvoltarea \u015fi preg\u0103tirea profesional\u0103.<\/p>\n<p>De asemenea, art. 13 prevede c\u0103 \u00eencadrarea \u00een munc\u0103 \u00een locuri de munc\u0103 grele, v\u0103t\u0103m\u0103toare sau periculoase (stabilite prin hot\u0103r\u00e2re a Guvernului) se poate face numai dup\u0103 \u00eemplinirea v\u00e2rstei de 18, dar \u0219i faptul c\u0103 \u00eencadrarea \u00een munc\u0103 a persoanelor sub v\u00e2rsta de 15 ani este interzis\u0103.<\/p>\n<p><strong>\u00cenc\u0103lcarea dispozi\u021biilor art. 256 alin. 1 privind regimului de munc\u0103 al minorilor constituie infrac\u0163iune \u015fi se pedepse\u015fte cu \u00eenchisoare de la 3 luni la 2 ani sau cu amend\u0103.<\/strong><\/p>\n<ol start=\"5\">\n<li><strong><em>Codul Muncii, art. 265 alin. 2 &#8211; <\/em><\/strong><strong>Primirea la munc\u0103 a unei persoane aflate \u00een situa\u0163ie de \u015federe ilegal\u0103 \u00een Rom\u00e2nia, cunosc\u00e2nd c\u0103 aceasta este victim\u0103 a traficului de persoane<\/strong><strong>.<\/strong><\/li>\n<\/ol>\n<p>S\u0103v\u00e2r\u0219irea acestei fapte de c\u0103tre angajator <strong>constituie infrac\u0163iune \u015fi se sanc\u0163ioneaz\u0103 cu \u00eenchisoare de la 3 luni la 2 ani sau cu amend\u0103<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>De asemenea, dac\u0103 munca prestat\u0103 de persoanele prev\u0103zute la art.265 alin. 2 este de natur\u0103 s\u0103 le pun\u0103 \u00een pericol via\u0163a, integritatea sau s\u0103n\u0103tatea, <strong>pedeapsa este \u00eenchisoarea de la 6 luni la 3 ani.<\/strong><\/p>\n<p>Totodat\u0103, <strong>\u00een cazul s\u0103v\u00e2r\u015firii acestei infrac\u021biunii, instan\u0163a de judecat\u0103 poate dispune \u015fi aplicarea uneia sau mai multora dintre urm\u0103toarele pedepse complementare:<\/strong><\/p>\n<ul>\n<li>pierderea total\u0103 sau par\u0163ial\u0103 a dreptului angajatorului de a beneficia de presta\u0163ii, ajutoare ori subven\u0163ii publice, inclusiv fonduri ale Uniunii Europene gestionate de autorit\u0103\u0163ile rom\u00e2ne, pentru o perioad\u0103 de p\u00e2n\u0103 la 5 ani;<\/li>\n<li>interzicerea dreptului angajatorului de a participa la atribuirea unui contract de achizi\u0163ii publice pentru o perioad\u0103 de p\u00e2n\u0103 la 5 ani;<\/li>\n<li>recuperarea integral\u0103 sau par\u0163ial\u0103 a presta\u0163iilor, ajutoarelor ori subven\u0163iilor publice, inclusiv fonduri ale Uniunii Europene gestionate de autorit\u0103\u0163ile rom\u00e2ne, atribuite angajatorului pe o perioad\u0103 de p\u00e2n\u0103 la 12 luni \u00eenainte de comiterea infrac\u0163iunii;<\/li>\n<li>\u00eenchiderea temporar\u0103 sau definitiv\u0103 a punctului ori a punctelor de lucru \u00een care s-a comis infrac\u0163iunea sau retragerea temporar\u0103 ori definitiv\u0103 a unei licen\u0163e de desf\u0103\u015furare a activit\u0103\u0163ii profesionale \u00een cauz\u0103, dac\u0103 acest lucru este justificat de gravitatea \u00eenc\u0103lc\u0103rii.<\/li>\n<\/ul>\n<p><strong>Angajatorul care a primit la munc\u0103 persoane aflate \u00een situa\u0163ie de \u015federe ilegal\u0103 \u00een Rom\u00e2nia, cunosc\u00e2nd c\u0103 aceastea sunt victime ale traficului de persoane va fi obligat s\u0103 pl\u0103teasc\u0103 sumele reprezent\u00e2nd:<\/strong><\/p>\n<ul>\n<li>orice remunera\u0163ie restant\u0103 datorat\u0103 persoanelor angajate ilegal. Cuantumul remunera\u0163iei se presupune a fi egal cu salariul mediu brut pe economie, cu excep\u0163ia cazului \u00een care fie angajatorul, fie angajatul poate dovedi contrariul;<\/li>\n<li>cuantumul tuturor impozitelor, taxelor \u015fi contribu\u0163iilor de asigur\u0103ri sociale pe care angajatorul le-ar fi pl\u0103tit dac\u0103 persoana ar fi fost angajat\u0103 legal, inclusiv penalit\u0103\u0163ile de \u00eent\u00e2rziere \u015fi amenzile administrative corespunz\u0103toare;<\/li>\n<li>cheltuielile determinate de transferul pl\u0103\u0163ilor restante \u00een \u0163ara \u00een care persoana angajat\u0103 ilegal s-a \u00eentors de bun\u0103voie sau a fost returnat\u0103 \u00een condi\u0163iile legii.<\/li>\n<\/ul>\n<p>Dac\u0103 infrac\u021biunea a fost s\u0103v\u00e2r\u0219it\u0103 de c\u0103tre un subcontractant, at\u00e2t contractantul principal, c\u00e2t \u015fi orice subcontractant intermediar, dac\u0103 au avut cuno\u015ftin\u0163\u0103 de faptul c\u0103 subcontractantul angajator angaja str\u0103ini afla\u0163i \u00een situa\u0163ie de \u015federe ilegal\u0103, pot fi obliga\u0163i de c\u0103tre instan\u0163\u0103, \u00een solidar cu angajatorul sau \u00een locul subcontractantului angajator ori al contractantului al c\u0103rui subcontractant direct este angajatorul, la plata sumelor de bani anterior men\u021bionate.<\/p>\n<p>A\u0218ADAR, CA \u00ceNTOTDEAUNA, NOI NE DORIM S\u0102 FII INFORMAT.<\/p>\n<p>Iar dac\u0103 \u00een continuare ai nel\u0103muriri, suntem aici pentru a r\u0103spunde \u00eentreb\u0103rilor tale.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Tu \u0219tiai c\u0103 \u0219i \u00een Codul Muncii sunt prev\u0103zute aspecte privind r\u0103spunderea penal\u0103?!
