{"id":1396,"date":"2021-06-06T12:16:05","date_gmt":"2021-06-06T10:16:05","guid":{"rendered":"https:\/\/avocat-buruian-caracas.ro\/?p=1396"},"modified":"2022-02-18T13:51:55","modified_gmt":"2022-02-18T11:51:55","slug":"tu-stii-care-sunt-drepturile-angajatului-si-obligatiile-angajatorului-in-cazul-unui-accident-de-munca","status":"publish","type":"post","link":"https:\/\/avocat-buruian-caracas.ro\/ro\/2021\/06\/06\/tu-stii-care-sunt-drepturile-angajatului-si-obligatiile-angajatorului-in-cazul-unui-accident-de-munca\/","title":{"rendered":"TU \u0218TII CARE SUNT DREPTURILE ANGAJATULUI \u0218I OBLIGA\u021aIILE ANGAJATORULUI \u00ceN CAZUL UNUI ACCIDENT DE MUNC\u0102?"},"content":{"rendered":"<p>Normele cu privire la accidentele de munca \u0219i implicit drepturile \u0219i obliga\u021biile angajatorilor \u0219i angaja\u021bilor \u00eentr-o atare \u00eemprejurare sunt reglementate de\u00a0<a href=\"https:\/\/www.iprotectiamuncii.ro\/legi\/legea-319-2006.pdf\"><em>Legea nr. 319\/2006<\/em><\/a><em>\u00a0privind s\u0103n\u0103tatea \u0219i securitate \u00een munc\u0103.<\/em><\/p>\n<p>Prin accident de munc\u0103 se \u00een\u021belege v\u0103t\u0103marea violenta a organismului, precum \u0219i intoxica\u021bia acut\u0103 profesional\u0103, care au loc \u00een timpul procesului de munc\u0103 sau \u00een \u00eendeplinirea \u00eendatoririlor de serviciu \u0219i care provoac\u0103 incapacitate temporar\u0103 de munc\u0103 de cel pu\u021bin 3 zile calendaristice, invaliditate ori deces.<\/p>\n<p><strong>Ce obliga\u021bii are angajatorul pentru a preveni accidentele de munc\u0103?<\/strong><\/p>\n<p>Conform legii, angajatorul are obliga\u021bia s\u0103 previn\u0103 eventualele accidente de munc\u0103 \u0219i s\u0103 asigure condi\u021bii necesare de lucru \u00een siguran\u021b\u0103, prin implementarea urm\u0103toarelor m\u0103suri:<\/p>\n<ul>\n<li>\u00centocmirea \u0219i aplicarea unui plan de prevenire \u0219i protec\u021bie, prin evaluarea riscurilor de s\u0103n\u0103tate \u0219i securitate \u00een munc\u0103;<\/li>\n<li>Informarea angaja\u021bilor cu privire la riscurile la care se expun la locul de munc\u0103, dar \u0219i despre m\u0103surile de prevenire \u0219i protec\u021bie necesare;<\/li>\n<li>Selectarea corespunz\u0103toare a angaja\u021bilor \u00a0prin angajarea doar a acelor persoane care, dup\u0103 examenul medical \u0219i cel psihologic, corespund sarcinilor de munc\u0103 pe care le vor \u00eendeplini. Totodat\u0103, angajatorul trebuie s\u0103 asigure un control medical periodic pentru persoanele deja angajate;<\/li>\n<li>Oferirea de echipament de lucru adecvat;<\/li>\n<\/ul>\n<p><strong>Ce trebuie s\u0103 fac\u0103 angajatorul \u00een cazul unui accident de munc\u0103?<\/strong><\/p>\n<p>\u00cen func\u021bie de tipul de incident care s-a produs, angajatorul trebuie s\u0103 comunice evenimentele de \u00eendat\u0103, dup\u0103 cum urmeaz\u0103:<\/p>\n<ul>\n<li><strong>La inspectoratele teritoriale de munc\u0103;<\/strong><\/li>\n<li><strong>La asigurator<\/strong>,\u00a0potrivit <em>Legii nr. 346\/2002<\/em> privind asigurarea pentru accidente de munc\u0103 \u015fi boli profesionale, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/li>\n<li><strong>Organelor de urm\u0103rire penala<\/strong>, dup\u0103 caz;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Dup\u0103 ce a fost constatat accidentul de munc\u0103, angajatorul are obliga\u021bia de a raporta evenimentul la Casa Na\u021bional\u0103 de Pensii Publice (CNPP), care va verifica situa\u021bia expus\u0103.<\/p>\n<p>\u00cen situa\u021bia \u00een care accidentul a avut drept consecin\u021b\u0103 decesul angajatului, institu\u021bia medico-legal\u0103 competent\u0103 va \u00eenainta o copie a raportului de constatare medico-legal\u0103 c\u0103tre Inspectoratul Teritorial de Munc\u0103, \u00een cel mult \u0219apte zile de la data decesului.<\/p>\n<p><strong><u>Drepturile angajatului \u00een cazul unui accident de munc\u0103<\/u><\/strong> sunt urm\u0103toarele:<\/p>\n<ul>\n<li><strong>Reabilitarea medical\u0103, <\/strong>respectiv gratuitate pentru asisten\u021ba medical\u0103 de urgen\u021b\u0103 acordat\u0103, serviciile medicale din spital, tratamentul medical ambulatoriu, investiga\u021bii de specialitate, tratamente de recuperare, cure balneoclimaterice sau tratamente \u0219i programe individuale de recuperare;<\/li>\n<li><strong>Indemniza\u021bie <\/strong>ce poate fi obtinu\u021b\u0103 \u00een baza certificatului medical vizat de c\u0103tre Direc\u021bia de S\u0103n\u0103tate Public\u0103 sau de c\u0103tre Casa de Pensii, dupa caz, sarcin\u0103 care \u00eei revine angajatorului. Valoarea indemniza\u021biei este de 80% din media veniturilor realizate \u00een ultimele sase luni. Daca exist\u0103 urgen\u021be medico-chirurgicale, valoarea indemniza\u021biei va fi de 100% din media venitului ob\u021binut \u00een ultimele \u0219ase luni, fiind acordat pentru 180 de zile \u00een decursul unui an;<\/li>\n<li><strong>Compensa\u021bii pentru atingerea integrit\u0103\u021bii<\/strong><strong>fizice,<\/strong> daca angaja\u021bii r\u0103m\u00e2n cu leziuni de natur\u0103 a le reduce capacitatea de munc\u0103 \u00eentre 20-50%. \u00centr-o atare situa\u021bie angaja\u021bii au dreptul s\u0103 solicite compensa\u021bii de la CNPP, \u00een baza deciziei medicului. Compensa\u021biile vor fi acordate integral, o singur\u0103 dat\u0103, \u00een limita unui plafon de cel mult 12 salariii brute \u0219i f\u0103r\u0103 a afecta celelalte indemniza\u021bii;<\/li>\n<li><strong>Ramburs\u0103ri de cheltuieli<\/strong>, CNPP put\u00e2nd s\u0103 ramburseze cheltuielile cu transportul de urgen\u021b\u0103, dispozitivele medicale implantate \u00een urma interven\u021biilor chirurgicale, ochelarii, aparatele acustice sau protezele care au fost deteriorate \u00een urma accidentelor de munc\u0103;<\/li>\n<li><strong>Despagubiri \u00een caz de deces<\/strong> a c\u0103ror valoare total\u0103 este de patru salarii medii brute, iar plata se face \u00een termen de 15 zile de la data la care a fost admis\u0103 cererea. O singur\u0103 persoan\u0103 poate beneficia de aceast\u0103 despagubire \u0219i poate fi so\u021bia\/so\u021bul, copilul, p\u0103rintele, tutorele, curatorul, mo\u0219tenitorul sau, \u00een lipsa acestora, persoana care dovede\u0219te c\u0103 a suportat cheltuielile de deces;<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>EXEMPLU \u00ceN MATERIE, DIN PRACTICA INSTAN\u021aELOR DE JUDECAT\u0102.<\/strong><\/p>\n<p>Prin ac\u0163iunea \u00eenregistrat\u0103 pe rolul Tribunalului\u00a0Prahova\u00a0la, reclamantul <strong>X<\/strong> a chemat \u00een judecat\u0103 pe p\u00e2r\u00e2ta <strong>Y<\/strong> , solicit\u00e2nd instan\u0163ei ca prin hot\u0103r\u00e2rea ce o va pronun\u0163a s\u0103 dispun\u0103 obligarea p\u00e2r\u00e2tei s\u0103 depun\u0103 la Casa Jude\u0163ean\u0103 de Pensii\u00a0\u00a0dosarul care atest\u0103 faptul c\u0103 a avut un\u00a0accident de munc\u0103\u00a0\u00een calitate de salariat al p\u00e2r\u00e2tei \u00een vederea achit\u0103rii indemniza\u0163iei pentru incapacitate temporar\u0103 de munc\u0103, precum \u015fi obligarea p\u00e2r\u00e2tei la plata prejudiciului material care i-a fost produs din culpa acesteia, reprezent\u00e2nd contravaloarea indemniza\u0163iei pentru incapacitate temporar\u0103 de munc\u0103 pe care era \u00eendrept\u0103\u0163it s\u0103 o primeasc\u0103, respectiv suma de 1000 lei lunar pentru \u00eentreaga perioad\u0103 de la data producerii\u00a0accidentului de munc\u0103\u00a0\u015fi p\u00e2n\u0103 \u00een prezent, respectiv suma total\u0103 de24.000 lei.<\/p>\n<p>\u00cen motivarea ac\u0163iunii, reclamantul a ar\u0103tat c\u0103 \u00eencep\u00e2nd cu data de 08.07.2016 s-a angajat la societatea p\u00e2r\u00e2t\u0103 \u00een calitate de muncitor necalificat, cu un salariu lunar de 1250 lei, fiind deta\u015fat \u00een exercitarea atribu\u0163iilor de serviciu la un centru comercial, iar la data de 25.07.2016 \u2013 orele 16:00, a primit ordin de la \u015feful de echip\u0103 \u00een sensul mut\u0103rii tubulaturii de ventila\u0163ie existent\u0103 \u00eentr-o \u00eenc\u0103pere situat\u0103 la etajul 2 al construc\u0163iei \u015fi care trebuia mutat\u0103 de dou\u0103 persoane din cauza gabaritului acesteia, sens \u00een care numitul \u00a0<strong>Z<\/strong> , cu care lucra \u00een echip\u0103 a prins elementul de tubulatur\u0103 din fa\u0163\u0103, iar reclamantul din spate, \u00eens\u0103, \u00een momentul \u00een care a f\u0103cut primul pas, a c\u0103zut brusc prin golul tehnologic existent \u00een plafon \u015fi despre care nu fuseser\u0103 anun\u0163a\u0163i \u00een prealabil, c\u0103z\u00e2nd \u00een gol pe o distan\u0163\u0103 de cca. 6 mp., fiind grav accidentat, necesit\u00e2nd pentru vindecare o perioad\u0103 \u00eendelungat\u0103 de spitalizare, ap\u0103r\u00e2nd \u015fi complica\u0163ii \u015fi fiind nevoit dup\u0103 externare s\u0103 se deplaseze \u00een scaun cu rotile o perioad\u0103 de 3 luni, fiindu-i acordat un concediu medical total de 251 zile.<\/p>\n<p>A precizat reclamantul c\u0103 incidentul a fost investigat de ITM \u015fi \u00eenregistrat ca\u00a0accident de munc\u0103, iar potrivit dispozi\u0163iilor legale aplicabile, cei viza\u0163i sunt \u00eendrept\u0103\u0163i\u0163i la concediu medical pentru\u00a0accidente de munc\u0103, durata de acordare a concediului medical pentru incapacitate temporar\u0103 de munc\u0103 put\u00e2nd fi de 180 zile \u00een interval de 1 an, ajung\u00e2ndu-se p\u00e2n\u0103 la o durat\u0103 de 270 zile pentru un an \u00een cazuri determinate, iar indemniza\u0163ia de incapacitate temporar\u0103 de munc\u0103 este de 80% din baza de calcul \u015fi de 100 % din baza de calcul \u00een cazul urgen\u0163elor medico &#8211; chirurgicale.<\/p>\n<p>\u00cen continuare, reclamantul a ar\u0103tat c\u0103, pentru a beneficia de aceast\u0103 indemniza\u0163ie, angajatorul este obligat \u00een temeiul legii s\u0103 depun\u0103 dosarul care cu prinde toate certificatele de concediu medical, actele medicale ale accidentatului \u00eempreun\u0103 cu dovada \u00eenregistr\u0103rii evenimentului ca fiind\u00a0accident de munc\u0103\u00a0la Casa Jude\u0163ean\u0103 de Pensii, institu\u0163ie care se ocup\u0103 de plata indemniza\u0163iei pentru incapacitate temporar\u0103 de munc\u0103, obliga\u0163ie ce nu a fost \u00eendeplinit\u0103 de c\u0103tre p\u00e2r\u00e2t\u0103 care, \u00een acest fel, l-a privat de indemniza\u0163ia la care are dreptul.<\/p>\n<p><strong>Examin\u00e2nd actele \u015fi lucr\u0103rile dosarului, instan\u0163a a re\u0163inut urm\u0103toarele:<\/strong><\/p>\n<p>Conform contractului individual de munc\u0103, procesului verbal de cercetare \u00eencheiat de o comisie din cadrul societ\u0103\u0163ii p\u00e2r\u00e2te, iar acesta s-a pr\u0103bu\u015fit brusc prin golul tehnologic existent \u00een plafon, f\u0103r\u0103 ca acel gol s\u0103 fi fost semnalizat \u00een vreun fel \u015fi f\u0103r\u0103 a fi informa\u0163i cu privire la existen\u0163a acelui gol tehnologic \u015fi a riscului de pr\u0103bu\u015fire \u00een gol, reclamantul fiind dus de urgen\u0163\u0103 la spital.<\/p>\n<p>Potrivit <em>art.\u00a0<\/em><a href=\"https:\/\/sintact.ro\/#\/dokument\/16833317\/2018-07-28?unitId=art(5)&amp;cm=DOCUMENT\">5<\/a>\u00a0<em>alin. 1 lit. a, art.\u00a0<\/em><a href=\"https:\/\/sintact.ro\/#\/dokument\/16833317\/2018-07-28?unitId=art(8)&amp;cm=DOCUMENT\">8<\/a>,<em> alin. 2 din\u00a0<\/em><a href=\"https:\/\/sintact.ro\/#\/dokument\/16833317\/2018-07-28?cm=DOCUMENT\"><em>Legea nr. 346\/2002<\/em><\/a><em>\u00a0republicat\u0103<\/em>, sunt asigurate obligatoriu prin efectul legii persoanele care desf\u0103\u015foar\u0103 activit\u0103\u0163i pe baza unui contract individual de munc\u0103, indiferent de durata acestuia, atribu\u0163iile specifice de asigurare pentru\u00a0accidente de munc\u0103\u00a0fiind exercitate de casele teritoriale de pensii, asigura\u0163ii av\u00e2nd dreptul, \u00een cazul\u00a0accidentelor de munc\u0103\u00a0la indemniza\u0163ie pentru incapacitate temporar\u0103 de munc\u0103.<\/p>\n<p>De asemenea, art. 34 prevede c\u0103 indemniza\u0163ia pentru incapacitate temporar\u0103 de munc\u0103 \u00een cazul\u00a0accidentului de munc\u0103\u00a0se suport\u0103 \u00een primele 3 zile de c\u0103tre angajator, iar dup\u0103 a 4-a zi de incapacitate, din contribu\u0163ia de asigurare pentru\u00a0accidente de munc\u0103, indemniza\u0163ie care se acord\u0103, pe baza certificatului medical eliberat conform dispozi\u0163iilor legale astfel cum prevede art. 37, la propunerea medicului curant cu avizul medicului asigur\u0103torului, <strong>astfel c\u0103 angajatorii au obliga\u0163ia, potrivit art. 50, s\u0103 comunice asigur\u0103torului accidentele soldate cu incapacitate de munc\u0103<\/strong>.<\/p>\n<p>Societatea p\u00e2r\u00e2t\u0103 \u00eens\u0103, \u00een calitate de angajator, nu \u015fi-a \u00eendeplinit obliga\u0163ia legal\u0103 de a comunica\u00a0accidentul de munc\u0103\u00a0de \u00eendat\u0103 de s-a produs , de a transmite casei de pensii dosarul de cercetare, concediile medicale c\u0103tre casa de pensii \u00een vederea aviz\u0103rii, etc.\u00a0, aceasta fiind singura care, \u00een calitate de asigurator, avea atribu\u0163ii specifice de a verifica caracterul evenimentului de\u00a0accident de munc\u0103\u00a0\u015fi de a stabili dac\u0103 \u015fi pentru ce perioad\u0103 reclamantul este \u00eendrept\u0103\u0163it s\u0103 \u00eencaseze indemniza\u0163ie pentru incapacitate temporar\u0103 de munc\u0103, \u00eenseamn\u0103 c\u0103 reclamantului i s-a produs un prejudiciu const\u00e2nd \u00een imposibilitatea de a beneficia de indemniza\u0163ia la care avea dreptul \u00een condi\u0163iile legii.<\/p>\n<p>Afirma\u0163iile p\u00e2r\u00e2tei conform c\u0103rora ar fi ne\u00eentemeiat\u0103 preten\u0163ia reclamantului de a i se acorda o indemniza\u0163ie pentru incapacitate temporar\u0103 de munc\u0103 \u00een cuantum de 1000 lei pe lun\u0103 de la data producerii accidentului \u015fi p\u00e2n\u0103 \u00een prezent, respectiv pentru o perioad\u0103 de 2 ani, mai ales c\u0103 certificatele medicale depuse la dosar atest\u0103 un num\u0103r de 183 zile de concediu medic al, nu pot fi avute \u00een vedere p\u00e2r\u00e2ta nu-\u015fi poate invoca propria culp\u0103 const\u00e2nd \u00een ne\u00eendeplinirea obliga\u0163iei referitoare la comunicarea actelor necesare c\u0103tre casa de pensii, pentru a ob\u0163ine protec\u0163ia unui drept const\u00e2nd \u00een exonerarea sa de la plata prejudiciului creat \u00een dauna p\u00e2r\u00e2tului \u00eencep\u00e2nd cu data producerii\u00a0accidentului de munc\u0103\u00a0\u015fi p\u00e2n\u0103 \u00een prezent, prin nedepunerea dosarului\u00a0accidentului de munc\u0103\u00a0suferit de acesta, reclamantul suport\u00e2nd astfel un prejudiciu material prin neacordarea indemniza\u0163iei la care avea dreptul din culpa angajatorului, prejudiciu ce nu poate fi acoperit dec\u00e2t prin plata sumei de 24.000 de lei.<\/p>\n<p><strong>\u00cen acest caz, instan\u021ba de judecat\u0103 <\/strong>a admis ac\u0163iunea formulat\u0103 de reclamantul \u00a0<strong>X, <\/strong>oblig\u00e2nd p\u00e2r\u00e2ta s\u0103 depun\u0103 la Casa de Pensii \u2013 Accidente de Munc\u0103\u00a0\u015fi Boli Profesionale dosarul care atesta faptul ca reclamantul a suferit un accident de munc\u0103, \u00een calitate de salariat al p\u00e2r\u00e2tei, \u00een vederea pl\u0103\u0163ii c\u0103tre reclamant a indemniza\u0163iei pentru incapacitate temporar\u0103 de munc\u0103.<\/p>\n<p><strong>Oblig\u0103 p\u00e2r\u00e2ta la plata c\u0103tre reclamant a prejudiciului material suferit, reprezent\u00e2nd contravaloarea indemniza\u0163iei pentru incapacitate temporar\u0103 de munc\u0103 pe care era \u00eendrept\u0103\u0163it s\u0103 o primeasc\u0103, respectiv suma de 1000 lei lunar, pentru perioada de la data producerii\u00a0accidentului de munca\u00a0\u015fi p\u00e2n\u0103 \u00een prezent, \u00een total suma de 24.000 lei.<\/strong><\/p>\n<p><strong>SFATUL NOSTRU?
